Identifying & getting claim against driver & owner via license plate re:accident?
Last night ( Thursday December 13,2007 ) @ 5:53 pm I was travelling on the Westbound I-80W just after the Ashby Ave exit but before where the I-80W splits into the I-880S & I-580 freeways.
Heavy stop and go traffic.
When a large semitruck trailering two large,seperate silver teardrop cylinder shaped containers / trailers began rolling backward. I thought it was going to stop after a second or two, but when it kept rolling back toward me ( as I was stopped behind it about 15 feet ) I began honking my horn intently hoping the driver would stop. I started to back up trying to not drive my rear end into the people behind me when the semitruck rolled into me and pushed my truck back another 2 seconds.
I honked again for him to stop after he hit me, as he began driving forward and he made no attempt at communicating with me, acknowledging he just hit me or getting out to make sure I was okay and for legal and insurance purposes. So I called 911 and they told me to not follow him but to pull over as soon as I safely could.
The driver of the semi trailer never stopped but just drove off down the I-880 S freeway.
I did get the license plate #, but my insurance company is telling me after i bought my policy with them that I am covered if I hit someone, if i cause damage to someones property, or if the person who hits me owns up to what they did they will collect from them.
But since this person drove off without even exchanging information or acknowledging backing into me with their huge trailering truck, this is questionable.
My insurance company claims investigator said all they are going to do is send a measley letter to whoever the dmv shows the plate is registred to, and hope they reply owning up to what the driver did. But if the company who owns or leases the trailers is not the same as the driver, or cannot be found easily they said that is all they will do.
So – I am asking if anyone can offer helpful suggestions as to how to go about finding the person driving the rig that night who ran into me, and the company he was working for.?
And how to go about making sure that I do not have to pay money that I can not currently afford to repair damages that they caused to my vehicle?
My insurance company is part of the problem. As i mentioned, they are saying they will do very little other than sending a wimply letter via mail to whoever the license plate is registered to asking if they hit me.
If my insurance company gets no response, they said they wont bother following up on it, and i am on my own.!! WTF did I pay them my trust, business & money for then?
I will at the least of course cancel my policies with this insurance company and find another one if they dont follow through and have my back on this one.
I have uninsured motorist coverage already.
The problem is that this guy drove away – hit and run. So my insurance company is viewing it as if he does have insurance but they dont know since he did not stop. So they wont pay as they are viewing it as collision even though i was not at fault in the accident. Crazy that they would cover me if someone else has no insurance but not if the other person who ran into me drives off without even checking to make sure im okay and exchanging insurnance information!
Make sure you have a police accident report and give them the info. Sounds like a hit and run to me! Thats all I can think of. Your insurance will take care of the rest.
